Control of budget estimates for expenditures using payment orders in Vietnam

Recently, the Ministry of Finance issued Circular 107/2008/TT-BTC to supplement certain points on the management and administration of the state budget.

Circular 107/2008/TT-BTC stipulates the control of budget estimates for expenditures and payments using payment orders as follows:

Principles for controlling budget estimates in Vietnam:

- For expenditures using payment orders assigned in the budget estimates (including supplementary estimates within the year) of state administrative agencies, public service providers, and other budget-using units, control of budget estimates shall be implemented in Tabmis; when allocating budget estimates, Level I budget-using units must assign detailed estimates to budget-using units to serve as a basis for input into Tabmis, and the financial agency and the State Treasury at the same level shall control the budget estimates when disbursing and paying for the beneficiaries.

- For expenditures using payment orders to execute tasks of direct assistance to foreign countries; expenditures for enterprises, economic, social organizations not regularly affiliated with the budget, and expenditures for urgent, extraordinary tasks using payment orders as decided by the competent authority: control of budget estimates will not be implemented in Tabmis when disbursing and paying for the beneficiaries.

Process of payment and settlement of expenditures using payment orders in Vietnam:

- Based on the assigned state budget estimates and task requirements, the financial agency shall inspect, control, and issue payment orders, simultaneously inputting into Tabmis to request the State Treasury at the same level to disburse and pay for the beneficiaries as stipulated.

- The State Treasury is responsible for verifying the legitimacy and legality of payment orders in Tabmis issued by the financial agency; based on the content of the payment orders, it shall disburse and pay for the beneficiaries within the time frame policies prescribe; also printing and storing revived documents and notifying the units. In case the documents are not legitimate or legal, the State Treasury must notify the financial agency no later than one day from the date of receiving the documents.
