Contract Between Publisher and Partner: Required Information

To be specific:, in addition to the information required by law regarding contracts, the partnership contract between the publisher and the partnering entity stipulated at Point b, Clause 3, Article 23 of the Publishing Law must contain all the information listed in Article 7 of Circular 01/2020/TT-BTTTT, as follows:

- Name and address of the publisher, the partnering entity.

- Name of the publication, name of the author.

- Form of publishing partnership as stipulated in Clause 2, Article 23 of the Publishing Law (Multiple forms of partnership may apply in one contract). Based on the form of partnership, clearly define the responsibilities of each party in carrying out the respective stages of that partnership.

- The responsibility of the publisher or the partnering entity to obtain the permission for using the work or material for publishing or reprinting from the author or the copyright holder, and to fulfill obligations and rights according to the law on intellectual property.

- The responsibility of the partnering entity in complying with the decisions of the general director (director) of the publisher regarding the suspension of distribution, recall, and destruction of violating publications.

It should be noted that the above-mentioned content and any other information (if any) must not contradict the provisions of the laws on publishing, printing, distributing publications, intellectual property law, and other relevant laws.
