On October 15, 2024, the Minister of Finance of Vietnam issued Decision 2449/QD-BTC regarding the Regulation on Implementing Democracy in operation of the Ministry of Finance of Vietnam.

Contents to be disclosed by Heads of agencies in the operation of the Ministry of Finance of Vietnam (Latest)

According to the provisions in Article 9 of the Regulation issued with Decision 2449/QD-BTC in 2024, except for state secrets, operational secrets, or information not yet disclosed as per legal regulations, the head of the agency or unit in Vietnam shall publicly disclose the following contents internally:

- Guidelines and policies of the Communist Party and the laws of the State related to the organization and activities of the agency or unit.

- Annual, quarterly, and monthly operational plans of the agency or unit.

- Figures, statements explaining state budget estimates approved by competent authorities, and other financial resources; the implementation of budget estimates and annual budget settlements of the agency or unit; results of addressing recommendations from the State Audit (if any).

- Standards, norms of using public assets; the situation of investment, construction, procurement, assignment, lease, use, recovery, transfer, functional conversion, sale, liquidation, destruction, and other forms of handling public assets; the exploitation of financial resources from managed public assets.

- Principles, criteria, allocation norms of public investment capital; principles, criteria, and bases for identifying project lists in medium-term and annual public investment plans; public investment plans and programs of the agency or unit, capital allocated annually, progress of implementation and disbursement of public investment programs; medium-term and annual public investment capital allocation plans including project lists and public investment capital for each project; mobilization of resources and other capital sources for public investment project implementation; situation and results of implementing plans, programs, projects; project progress and disbursement; evaluation and acceptance results of programs, projects; public investment capital settlement.

- Recruitment, reception, training, fostering, transfer, appointment, reappointment, rotation, secondment, resignation, dismissal, planning, change of job position; working contract, change of professional title, change of job position, termination of working contract; business trip abroad; policy resolution, salary increase, rank promotion, evaluation, classification of officials and public employees, workers; commendation, discipline, resignation, retirement for officials and public employees, workers; projects, programs, plans, and legal document development of the agency or unit as per Law regulations.

- Conclusions of competent authorities on negative, corrupt, wasteful incidents within the agency or unit; asset and income declarations of those obliged to declare as per legal regulations.

- Results of inspections, checks, complaints, denunciations, and recommendations resolution within the agency or unit.

- Internal regulations, rules, conventions of the agency or unit; codes of conduct for individuals with positions and powers within the agency or unit.

- Summarized opinions and explanations, the reception of opinions from officials and public employees, workers on the contents they participate in as stipulated in Article 16 of the Regulation issued with Decision 2449/QD-BTC in 2024.

- Directives and operational documents from the supervisory managing agency related to the activities of the agency or unit.

- Other contents as per legal regulations and the democratic implementation regulations of the agency or unit.

More details can be found in Decision 2449/QD-BTC which comes into force in Vietnam from October 15, 2024.
