Contents of Urban Architecture Management Regulations

Recently, the Government has issued Decree 85/2020/ND-CP guiding the implementation of the Law on Architecture. One of the significant contents of this Decree is the regulation on the management regime of urban and rural architecture.

Specifically, according to Article 12 of Decree 85/2020/ND-CP, the management regulations on architecture include the following main contents:

- General provisions:

- Regulations on architectural management for the entire area of the established regulations: Specifying the overall scope and boundaries for establishing the regulations;- General urban planning indicators, subdivision planning approved by the competent authorities (if any), applicable national or local technical standards and norms;- Orientation for controlling space, architecture, and landscape of the entire urban area;- Identifying areas requiring separate urban design; locations and scale of constructions requiring architectural design competitions;- Regulations on construction architecture to ensure disaster prevention and adaptation to climate change.

- Specific provisions:

- Regulations on architecture for each area within the urban area according to administrative boundaries or functions and characteristics; for conservation areas;- Regulations on architecture for specific streets, squares, central areas, urban gateways; arrangement of signage, advertisements, urban utilities; areas prioritized for renovation and implementation plans; areas with special management requirements; rural areas within the urban context;- Regulations on colors, building materials; requirements for facades, roofs, and first floors of buildings;- Regulations on architectural management for residential buildings, public works, urban utility works, industrial works, and technical infrastructure works;- Regulations on managing and protecting valuable architectural works.

- Identifying requirements on national cultural identity in architecture:

- Specific elements related to natural conditions, economy, culture, and local customs pertaining to architectural identity;- Characteristic architectural forms; construction techniques and use of traditional local materials;- Selection of options, architectural orientations ensuring national cultural identity in new constructions and renovation of architectural works.

- The contents stipulated in points e, g, and h, clause 3, Article 14 of the Law on Architecture.
