On November 12, 2024, the Minister of Public Security of VIentam issued Circular 63/2024/TT-BCA stipulating the inspection, control, and handling of legal violations in the field of rail traffic by the Traffic Police.

Contents of railway traffic inspection and control in Vietnam from January 1, 2025​

The contents of rail traffic inspection and control in Vietnam are stipulated in Article 11 of Circular 63/2024/TT-BCA as follows:

The inspection and control content in Vietnam is carried out in accordance with the 2017 Railway Law; Decree 100/2019/ND-CP; Decree 123/2021/ND-CP, and the following provisions:

- Inspect and control compliance with regulations on rail traffic signals and rules.

- Inspect and control compliance with regulations on the protection of rail infrastructure.

- Inspect and control the conditions of rail transport vehicles, guidance information, passenger service equipment, and safety equipment on rail transport vehicles.

- Inspect and control the conditions stipulated for railway staff directly serving train operation when on duty.

- Inspect and control compliance with rail traffic safety regulations by railway staff while performing their assigned duties.

- Inspect and control compliance with traffic rules at level crossings between roads and railways, joint road and railway bridges, railway tunnels, and within the railway safety corridor.

- Inspect and control compliance with regulations ensuring security, order, and safety on railway routes by organizations and individuals.

- Inspect and control compliance with regulations on the carriage of passengers, luggage, and cargo by rail; adherence to regulations on load, and transport of oversized, overweight goods.

Regulations on conducting rail traffic inspection and control in Vietnam from January 1, 2025

According to Article 10 of Circular 63/2024/TT-BCA, regulations on conducting rail traffic inspection and control are as follows:

- When inspecting and controlling rail traffic participants and railway staff directly serving train operation, traffic police officers assigned to inspection and control duties perform as follows:

+ Salute according to the People's Public Security regulations (except when it is known beforehand that the person is committing acts with signs of criminal offenses, caught in flagrante delicto, being wanted, or sought). When interacting with individuals violating the law, traffic police officers must maintain proper posture, demeanor, and appropriate behavior;

+ Notify the person being inspected or controlled of the reasons for inspection or control; request the presentation of relevant documents according to regulations for inspection or control.

If the person being inspected or controlled presents physical copies of documents, directly check those documents and search information related to those documents in the administrative violation database regarding order, traffic safety, and other databases;

If the person being checked or controlled presents information of documents that have been integrated and updated in the electronic identification card, electronic identification account on the national identification application, in the database managed by the Ministry of Public Security, conduct inspection and control through the information in the electronic identification card, electronic identification account on the national identification application, databases, which have the same effect as directly checking those documents.

- Carry out the inspection and control contents according to item 1.

- Upon completing the inspection and control, traffic police officers report to the Team Leader on the results of the inspection and control; notify the person being inspected or controlled and related persons of the results of the inspection and control, any violations (if any), and the measures taken.

- When there are grounds to suspect that the person participating in traffic, transport vehicles, or objects are concealing exhibits, means, or documents used for administrative violations, conduct searches of the person, transport vehicles, and objects according to the law on handling administrative violations.

- If signs of criminal offenses are detected, proceed according to the law on criminal procedure.

Circular 63/2024/TT-BCA takes effect on January 1, 2025.
