On October 7, 2024, the Prime Minister of the Government of Vietnam issued Decision 1116/QD-TTg regarding the Implementation Plan of Law on Archives 2024.
To develop and promulgate decrees detailing the implementation of certain provisions of Law on Archives 2024:
(1) Develop a decree detailing certain provisions of Law on Archives 2024:
- Leading agency: Ministry of Home Affairs of Vietnam.
- Coordinating agencies: Ministry of Justice, Office of the Government of Vietnam, and relevant agencies.
- Completion deadline: March 2025.
(2) Develop and promulgate circulars detailing the implementation of certain provisions of Law on Archives 2024:
- The Ministry of Home Affairs, in cooperation with relevant ministries and agencies, develops and promulgates circulars: (1) Circular detailing Clause 2, Article 29; Clause 3, Article 34; Clause 7, Article 36; (2) Circular detailing Clause 2, Article 13; Clause 6, Article 16; Clause 3, Article 19; Clause 5, Article 23; Clause 6, Article 39; Clause 7, Article 56.
Completion time: April 2025.
- The Ministry of National Defense, in cooperation with relevant ministries and agencies, develops and promulgates circulars: (1) Circular stipulating archives within the scope of management; regulation on the principles of submission, preservation, usage, and taking out national defense sector archival documents for domestic and international use; destruction of digital archives of the national defense sector (Clause 4, Article 24; Clause 5, Article 36; Point a, Clause 3, Article 59); (2) Circular issuing standards for confidentiality and authentication in archival activities for agencies of the Communist Party and State under the state management field of cipher and official digital signatures (Clause 6, Article 36).
Completion time: April 2025.
- The Ministry of Public Security, in cooperation with relevant ministries and agencies, develops and promulgates circulars: (1) Circular stipulating the archival of commonly formed documents in the People's Police (Clause 5, Article 15; Clause 4, Article 24; Point a, Clause 3, Article 59); (2) Circular regulating dossier of professional files of the People's Police (Clause 5, Article 15; Clause 4, Article 24; Point a, Clause 3, Article 59, determined to be confidential).
Completion time: April 2025.
- The Ministry of Foreign Affairs, in cooperation with relevant ministries and agencies, develops and promulgates a circular detailing certain provisions of Law on Archives 2024 (Clause 5, Article 15; Clause 4, Article 24; Clause 5, Article 36; Clause 3, Article 59).
Completion time: April 2025.
- The Ministry of Information and Communications, in cooperation with relevant ministries and agencies, develops and promulgates a circular on technical standards for network information security in electronic document archiving (Clause 4, Article 58).
Completion time: April 2025.
- The Ministry of Finance, in cooperation with relevant ministries and agencies, develops and promulgates a circular on the fees for issuing archival practice certificates (Clause 2, Article 63).
Completion time: April 2025.
- Ministries, agencies at the same level (except the Ministry of Public Security and Ministry of Foreign Affairs), the Supreme People's Court, and the Supreme People's Procuracy lead, in cooperation with the Ministry of Home Affairs, in developing and promulgating a circular stipulating the storage period for dossiers and documents (Clause 5, Article 15).
Completion time and obtaining opinions from the Ministry of Home Affairs before February 2025; incorporation and submission for promulgation before April 2025.
(The list and responsibilities of leading agencies drafting detailed implementation documents for laws and resolutions passed by the XV National Assembly at the 7th session accompany Decision 717/QD-TTg dated July 27, 2024, by the Prime Minister of the Government of Vietnam).
(3) It is recommended that the State Audit lead, in cooperation with the Ministry of Home Affairs, in developing and promulgating a Decision of the State Auditor General on the archival period for dossier and documents in the audit field (Clause 5, Article 15) to ensure synchronous implementation with Law on Archives 2024.
