Regarding this issue, LawNet would like to answer as follows:

On September 8, 2023, the Minister of Construction issued Circular 06/2023/TT-BXD, guiding a number of contents on urban development programs.

Content of the urban development program in the area expected to form a new urban area in Vietnam

Specifically, the urban development program for the area expected to form new urban areas will have the following content:

(1) The content of the urban development program for the area expected to establish a centrally run city shall comply with the provisions of Point a, Clause 6, Article 3a of the Decree on urban development investment management (Decree 11/2013/ND-CP, amended in Decree 35/2023/ND-CP) and the following detailed regulations:

- Urban development targets include: Number of districts; list of districts and wards expected to be established; number of urban areas; list of urban areas; urban areas expected to have their boundaries adjusted; and new urban areas expected to be established in the area expected to establish a centrally run city according to urban classification;

Standards lower than the minimum level according to urban classification standards for areas expected to establish centrally run cities, for areas expected to establish new districts and wards and for urban areas in areas expected to establish centrally run cities;

- Key programs and projects to gradually implement sustainable urban development specified in Point d, Clause 3, Article 3a of the Decree on urban development investment management include:

One or several relevant national programs and projects (if any) and provincial levels on urban development to respond to climate change, urban development for green growth, emission reduction, and smart urban development
or other national and provincial programs and projects to concretize urban sustainable development targets;

Preliminarily estimate the overall funding needs, and within the time frame of the program and implementation phase, the agency responsible for presiding over the development will submit it to the competent authority for approval;

- Urban development investment projects using public investment capital and other capital sources other than public investment capital specified in Point dd, Clause 3, Article 3a of the Decree on urban development investment management are arranged. In order of priority for each 5-year and 10-year period, including:

Projects implementing programs, plans, and projects specified in Point b of this Clause; projects to complete standards according to urban classification standards specified in point a of this clause; Other urban development investment projects to implement approved planning (if any);

- After establishing a centrally run city, the Provincial People's Committee directs the review of the approved content of the urban development program for the area expected to establish a centrally run city to adjust or establish a new urban development program to ensure compliance with the provisions of Point b, Clause 4, Article 3a of the Decree on urban development investment management.

(2) The content of the urban development program for areas expected to form new urban areas to establish cities, towns, and townships shall comply with the provisions of Point b, Clause 6, Article 3a of the Decree on urban development investment management and the following detailed regulations:

- Urban development targets include standards lower than the minimum level according to urban classification standards for the entire urban area and for areas expected to establish wards (if any);

- Urban development investment programs and projects using public investment capital and capital sources other than public investment capital are arranged in order of priority, including: Projects to perfect urban classification standards specified in Point a of this Clause; Other urban development investment projects to implement approved planning (if any);

- After establishing cities, towns, and townships, the Provincial People's Committee directs the review of the approved content of the urban development program for areas expected to establish cities, towns, and townships to adjust or establish a new urban development program to ensure compliance with the provisions of Clause 5, Article 3a of the Decree on urban development investment management.

Circular 06/2023/TT-BXD takes effect on November 10, 2023.
