The Ministry of Health is the Prime Minister's drafting Decision on the establishment, organization, and operation of the National Medical Council.
The basic content of the draft Prime Minister's Decision on the establishment, organization, and operation of the National Medical Council includes:
1. Legal position
The National Medical Council is an organization with the function of helping the Prime Minister independently evaluate the capacity to practice medical examination and treatment.
The National Medical Council has its own seal, account, and headquarters located in Hanoi City.
The National Medical Council's operating budget is provided by the state budget and other legal funding sources to support the Council's activities.
2. Tasks
- Preside and coordinate with social and professional organizations in medical examination and treatment and other relevant agencies and organizations in developing a toolkit for assessing the capacity to practice medical examination and treatment.
- Issue a toolkit to assess medical examination and treatment practice capacity.
- Preside over organizing inspection and assessment of medical examination and treatment practice capacity.
- Receive and resolve petitions and complaints, or coordinate with state management agencies in resolving complaints and denunciations about the results of testing and assessing the capacity to practice medical examination and treatment.
- Perform other tasks as assigned by the Prime Minister.
3. Organizational structure
3.1. The National Medical Council consists of a Chairman, no more than 03 Vice Presidents and Council members, including:
The Chairman of the Council is the concurrent leader of the Ministry of Health; There is 01 permanent Vice Chairman who operates full-time. The Prime Minister appoints and dismisses the Chairman and Vice Chairman of the Council.
The Council has from 27 to 29 members appointed and dismissed by the Chairman of the National Medical Council, including: representatives of medical examination and treatment facilities; representatives of health sector training facilities; representatives of professional associations and medical experts; and representatives of state management agencies.
The term of office of the Chairman, Vice Chairman and Members of the National Medical Council is 05 years and can be reappointed, but not to exceed 02 consecutive terms.
Standards, conditions, and procedures for the appointment and dismissal of Vice Presidents and Members of the National Medical Council prescribed in the Regulations on Organization and Operation of the National Medical Council issued by the Prime Minister.
3.2. Specialized Committees:
The National Medical Council has specialized committees that assist the Council in carrying out tasks in each specific field of expertise. The Chairman of the National Medical Council decides to establish and promulgate the functions, tasks, standards, and procedures for appointing members of the Professional Committee.
3.3. Office of the National Medical Council:
The Office of the National Medical Council is the supporting agency of the National Medical Council, located in Hanoi; is the Council Office with specialized departments and functional departments in planning, finance, administration, and organization.
The Office of the National Medical Council has legal status, its own seal and account, and is headquartered in Hanoi.
The Office of the National Medical Council was established by the Chairman of the National Medical Council and works according to the organization and operation regulations issued by the Chairman of the Council. The Chairman of the National Medical Council appoints and dismisses the Chief of Office and Deputy Chief of Office of the National Medical Council.
Number of people working at the Office of the National Medical Council assigned by the Ministry of Home Affairs; In addition, according to needs and work tasks, the Office of the National Medical Council has human resources working on a part-time basis, seconded from state management agencies, public service units, and professional associations in the medical field,...and labor contracts according to regulations.
The operating budget of the Office of the National Medical Council is included in the operating budget of the Council, guaranteed by the state budget and other legal funding sources.
4. Responsibility for implementation
4.1. Chairman of the National Medical Council:
Submit to the Prime Minister for promulgation the Regulations on the organization and operation of the National Medical Council.
Establish the Office of the National Medical Council and promulgate the Regulations on Organization and Operation of the Office of the National Medical Council, standards, conditions, and procedures for appointing the Chief of the Office and Deputy Chief of the Office.
Establish and promulgate functions, tasks, standards, conditions, and procedures for appointing members of the Professional Committee.
4.2. Health Minister:
Coordinate and support the National Medical Council to organize and implement tasks assigned by the Government.
4.3. Minister of Home Affairs:
Provide guidance on the mechanism to assign the number of people working for the Office of the National Medical Council; arrange the number of people working for the Office of the National Medical Council.
4.4. Minister of Finance:
Provide guidance on financial mechanisms to ensure the operations of the National Medical Council and the Office of the National Medical Council; arrange annual funding to ensure the operation of the National Medical Council and the Office of the National Medical Council.
