Circular 01/2016/TT-BCA (effective from February 15, 2016) stipulates that traffic police officers (CSGT) are permitted to operate in plainclothes while conducting patrols and traffic control on roadways. However, operating in plainclothes during duty must meet the following conditions:
- First, there must be a patrol and control plan approved by competent authorities. To be specific:- The Director of the Traffic Police Department, the Director of Provincial Level Public Security, and higher authorities have the right to decide on public patrol and control combined with plainclothes in the following cases:- Plainclothes officers use technical and professional means and equipment to enhance the effectiveness of ensuring traffic order and safety (ATGT);- Combating crime; when the security, order situation or traffic order and safety is complicated.- The Head of the Highway Patrol Department under the Traffic Police Department, the Head of the Traffic Police, and the Head of District Level Public Security have the authority to decide on public patrol and control combined with plainclothes in cases where plainclothes officers use technical and professional means and equipment to enhance the effectiveness of ensuring traffic order and safety.- Second, the content of the plan must clearly state the method of implementation, forces, mode of communication, time, patrol and control area; means and technical equipment used for patrol and control;- Third, the patrol and control team must arrange a section of officers in the team to be in plain clothes (wearing civilian clothes) to monitor the traffic order situation, detect and combat law violations. When a violation is detected, they must immediately notify the public patrol and control section to proceed with control and handling according to the legal provisions;- Fourth, the plainclothes section and the public patrol and control section within a patrol and control team must maintain a proper distance to ensure prompt and lawful handling of violations;- Fifth, it is strictly forbidden to abuse public patrol and control combined with plainclothes to harass, cause inconvenience, or damage the interests of the State, the legitimate rights, and interests of citizens, agencies, and organizations.
