When are Communist Party members who have been expelled from the Communist Party readmitted? This is a question that the Legal Secretary has recently received quite a lot from valued Customers and Members. The Legal Secretary would like to address this issue in the article below.

According to the provisions of Clause 5, Article 4 of Regulation 29/QD-TW, individuals who have been expelled from the Communist Party may be reconsidered for re-admission to the Communist Party if they meet the following conditions:
- Fulfill the requirements and standards for Communist Party membership as stipulated in Article 1 of the Communist Party Charter.
- At least 36 months have elapsed since they left the Communist Party (for those convicted of minor criminal offenses, 60 months must have elapsed since their criminal record was expunged), and they must submit an application for re-admission to the Communist Party; must receive written consent from the standing committee of the provincial or municipal party committee (or equivalent), and be considered and decided by the competent party committee (district party committee or equivalent).
- Adhere to the proper procedures for admitting party members as specified in Clauses 1, 2, and 3, Article 4 of the Communist Party Charter.
Notably, for Communist Party members who were expelled due to violations of population policy and family planning, according to the provisions of Article 4 of Regulation 05/QD-TW, these individuals may only be considered for re-admission to the Communist Party if they meet the following conditions:
- Meet the standards and conditions stipulated by the Communist Party Charter, Central regulations, guidelines, and the practical requirements of local party-building work;
- Are reputable within their agencies, units, and residential communities, and are highly regarded by the party committees at their workplace and residence, as well as by the organizations to which they belong, for their performance of assigned duties and responsibilities to the people;
- Have made at least 24 months of effort in cases of having a third child or 36 months in cases of having a fourth child from the date of birth to the date the party cell convenes to consider the application for party re-admission.
Note:
- Individuals previously expelled from the Communist Party for the following reasons will not be reconsidered for re-admission:
- Voluntarily leaving party activities or submitting a withdrawal application (except in cases of exceptional family difficulties);- Causing serious internal disunity;- Convicted of corruption;- Convicted of serious crimes or worse.
- Re-admission will only be granted once, and re-admitted party members must undergo a probationary period.
