Regarding this issue, LawNet would like to answer as follows:

On October 12, 2023, the Minister of Science and Technology issued Circular 20/2023/TT-BKHCN on the direct selection and assignment of organizations and individuals to perform national-level science and technology tasks using the state budget.

Conditions for participating in selection to perform national science and technology tasks from November 27, 2023 in Vietnam 

Specifically, Article 4 of Circular 20/2023/TT-BKHCN stipulates conditions for participating in selection to perform national science and technology tasks using the state budget as follows:

(1) Organizations with legal status and activities consistent with the requirements of the task have the right to register to participate in the selection process for performing the task.

(2) Organizations falling into one of the following cases are not eligible to register to participate in the selection of task leaders:

- At the deadline for submitting the registration application to participate in the selection, the registration, handover, and storage of results of other national-level tasks have not been completed according to current regulations;

- At the time of the deadline to submit the registration application to participate in the selection, the application report on the results of other national-level tasks had not been submitted according to current regulations;

- At the deadline to submit the registration application to participate in the selection, you have not submitted the application for assessment and acceptance of another national-level task chaired by you after 30 days from the end of the time period for performing tasks under the Contract, including extended time (if any);

- At the deadline for submitting the registration application to participate in the selection, the funds recovered according to the contract to perform the signed tasks have not been fully refunded;

- If there is a violation that leads to being suspended from performing other tasks, you will not be allowed to register to participate in the selection within 01 year from the date of the suspension decision from the competent authority.

(3) Individuals registering to participate in selection to be task leaders must simultaneously meet the following requirements:

- Have a university degree or higher;

- Have expertise in the field of science and technology consistent with the content of tasks and activities in this field in the last 5 years, up to the deadline for submitting the application;

- Have the ability and ensure time to organize and carry out tasks;

- Cases different from the requirements in Points a, b, and c of this Clause shall be decided by the Minister of Science and Technology.

(4) Individuals falling into one of the following cases are not eligible to register to participate in selection as task leader:

- At the time of the deadline to submit the registration application to participate in the selection, he/she is in charge of another national-level assignment;

- At the deadline to submit the registration application to participate in the selection, the application for assessment and acceptance of another national-level task under the responsibility of the leader has not been submitted after 30 days from the end of the time period for performing tasks under the Contract, including extended time (if any);

- Committing violations that lead to suspension from performing tasks under his or her leadership for a period of 03 years from the date of the suspension decision from the competent authority.

General principles on selection to perform national science and technology tasks in Vietnam

The selection of organizations and individuals to perform national science and technology tasks using the state budget must comply with the general principles specified in Clause 1, Article 3 of Circular 20/2023/TT-BKHCN, as follows:

- The selection must ensure fairness, openness, transparency, democracy, and objectivity; the selection results must be publicly announced on the National Science and Technology Task Management System, the Electronic Information Portal of the Ministry of Science and Technology, or other mass media;

- Applications to participate in the selection are evaluated through the Selection Advisory Council (hereinafter referred to as the Advisory Council) established by the Minister of Science and Technology.

The evaluation is conducted by scoring according to specific groups of criteria specified in Article 12 of Circular 20/2023/TT-BKHCN;

- Based on the advice of the Advisory Council and the advice of the professional management unit, the Minister of Science and Technology decides to select organizations and individuals to perform the task. In cases of necessity, the Minister of Science and Technology will seek the opinions of independent consultants before making a decision.
