On June 25, 2024, the Government issued Decree 68/2024/ND-CP regulating specialized digital signatures for public service.

Conditions for issuing new specialized digital signatures and digital certificates for public service in Vietnam from August 15, 2024

Article 10 Decree 68/2024/ND-CP outlines the conditions for issuing new specialized digital signatures and digital certificates for public service effective August 15, 2024, as follows:

(1) Conditions for issuing new specialized digital signatures and digital certificates for public service to individuals:

• Must be individuals from agencies and organizations specified in Article 2 of Decree 68/2024/ND-CP and need to perform electronic transactions.
• Must have a formal request from the directly managing agency or organization.

(2) Conditions for issuing new specialized digital signatures and digital certificates for public service to agencies and organizations:

• Must be agencies or organizations with legal status as stated in Article 2 of Decree 68/2024/ND-CP.
• Must have a formation decision or confirmation from the head of the directly overseeing agency or organization.
• Must have a formal request from the directly managing agency or organization.

(3) Conditions for issuing new specialized digital signatures and digital certificates for public service for devices, services, and software:

• The devices, services, or software must be owned or managed by agencies or organizations with legal status as specified in Article 2 of Decree 68/2024/ND-CP.
• Must have a formal request from the directly managing agency or organization.

Applications, procedures, and process for issuing specialized digital signatures and digital certificates for public service Effective August 15, 2024

The applications, procedures, and process for issuing specialized digital signatures and digital certificates for public service effective August 15, 2024, will be carried out in accordance with Article 11 of Decree 68/2024/ND-CP, specifically as follows:

• Request for issuing specialized digital signatures and digital certificates for public service:

• Specialized digital signatures and digital certificates for public service for individuals:

The directly managing agency or organization must submit a formal request for issuing specialized digital signatures and digital certificates for public service using Form No. 01 annexed to Decree 68/2024/ND-CP to the organization providing official digital signature certification services.

• Specialized digital signatures and digital certificates for public service for agencies and organizations:

The directly managing agency or organization must submit a formal request for issuing new specialized digital signatures and digital certificates for public service using Form No. 02 annexed to Decree 68/2024/ND-CP to the organization providing official digital signature certification services.

• specialized digital signatures and digital certificates for public service for devices, services, and software:

The directly managing agency or organization must submit a formal request for issuing new specialized digital signatures and digital certificates for public service using Form No. 03 annexed to Decree 68/2024/ND-CP to the organization providing official digital signature certification services.

• Within 03 working days from the date of receiving valid applications, the organization providing official digital signature certification services must check the applications, create key pairs, and issue specialized digital signatures and digital certificates for public service, ensuring the storage device for the secret key for the subscriber.

Notify the time and place for receiving the secret key storage device to the directly managing agency or organization; or send account information to the subscriber in the case of implementing a centralized signature solution.

If the request for issuing an official digital signature certificate is not approved, the organization providing official digital signature certification services must notify in writing, stating the reasons to the directly managing agency or organization.

• The directly managing agency or organization is responsible for receiving the secret key storage device from the organization providing official digital signature certification services; immediately after handing over the secret key storage device to the subscriber, send a notification using Form No. 07 annexed to Decree 68/2024/ND-CP to the organization providing official digital signature certification services for management purposes.
