Conditions for Integrating Cadastral Mapping with Issuing Land Use Rights Certificates

Recently, the Minister of Natural Resources and Environment signed and promulgated Circular 30/2013/TT-BTNMT which stipulates the integration of cadastral map surveying and mapping or adjustment, and the registration and issuance of Certificates of Land Use Rights, Ownership of Housing, and Other Assets Attached to Land, the construction of cadastral dossiers, and the cadastral database.

Conditions to ensure the integration of cadastral mapping and registration, issuance of the Land Use Right Certificate, Ownership of Residential House and Assets Attached to Land, construction of cadastral records, and cadastral database are prescribed by Circular 30/2013/TT-BTNMT as follows:

- The investment project or economic-technical justification or technical design and approved estimate must include all necessary steps to be carried out as prescribed below:

- In case cadastral mapping or cadastral map adjustment is required, the steps to be carried out must include: cadastral mapping or adjustment; land registration, registration of assets attached to land, issuance of the Certificate; construction of cadastral records, cadastral database;- In case cadastral mapping or cadastral map adjustment has been completed but land registration and issuance of the Certificate have not been finished, the steps to be carried out must include: land registration, registration of assets attached to land, issuance of the Certificate; construction of cadastral records, cadastral database.

- The implementation plan must be developed and uniformly carried out by all participating forces, including the natural resources and environment agencies; Land Use Right Registration Offices at provincial and district levels; People's Committees at the commune level, and consulting units (if any); showing the specific tasks of each step to be carried out; tasks that must be integrated between the steps; time for deployment and completion, inspection time, and acceptance for each task of each step; executing force for each specific task.- Funds for carrying out the steps specified in Clause 1 of this Article must be fully allocated, ensuring the time for deployment and implementation of each task and step according to the approved plan.- Specialized forces at the commune, district, provincial levels, and consulting units (if any) directly participating in each commune must be organized into a unified force within each commune, district task force; ensuring clear, specific assignment of responsibilities to each member or group of members and must sign commitments to perform tasks among the executing forces, ensuring the time according to the agreed plan.
