Conditions for Eligibility for Allowances for Retired Teachers Who Have Not Received Seniority Allowance

Teachers falling under the provisions defined in Article 2 of Decree 14/2020/ND-CP who have not received seniority allowances in their pensions will be entitled to an allowance upon meeting the following conditions:

- Directly teaching, educating, guiding practice, and participating in social insurance from 5 years (full 60 months) or more;

- Retired within the period from January 1, 1994, to May 31, 2011.

- Receiving pension at the time of January 1, 2012. In the case of a temporary suspension of pension according to the provisions of the Social Insurance Law, the allowance shall be granted after the pension is resumed.

The one-time allowance amount, calculated as follows: Allowance amount = (monthly pension x 10%) x number of years of allowance eligibility

Specifically, for cases where eligible teachers have not been resolved policies and passed away from January 1, 2012, onwards, the authorized representative of the deceased's relatives (including: spouse, father, mother, adoptive father, biological child, adoptive child of the deceased) shall prepare the dossier and receive the allowance according to the regulations. The authorized representative of the deceased teacher's relatives shall be legally responsible for the dossier and the amount of the received allowance.

Moreover, for teachers eligible for allowances as regulated in Decision 52/2013/QD-TTg, whose dossiers have been received by the social insurance agency but the allowance decision has not been issued before the effective date of Decree 14/2020/ND-CP, the allowance amount shall be in accordance with the provisions of this Decree.
