The following article contains information about the conditions for approval of educational operations of secondary schools in Vietnam from November 20, 2024, as stipulated in Decree 125/2024/ND-CP.

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP on regulatory requirements for educational investment and business operation in Vietnam.

1. Conditions for approval of educational operations of secondary schools in Vietnam from November 20, 2024

According to the provisions of Article 27 of Decree 125/2024/ND-CP, the conditions for approval of educational operations of secondary schools in Vietnam include:

- Having land, physical facilities, and equipment that meet the standards for location, scale, area, and minimum physical facilities for secondary and high schools as prescribed by the Ministry of Education and Training.

For special-grade urban areas, the construction land area of the school can be replaced by construction floor area, ensuring that the floor area is not less than the average minimum land area per student as prescribed.

- Having an educational program, teaching and learning materials that meet the requirements of the general education program as prescribed by the Ministry of Education and Training.

- Having a team of management staff, teachers, employees, and workers sufficient in quantity and meeting the standards to organize educational operations that meet the requirements of the general education program as prescribed by the Ministry of Education and Training.

- Having sufficient financial resources to ensure the maintenance and development of educational operations:

+ For private secondary schools, the investment level is at least 50 million VND per student (excluding land use costs). The total investment capital is calculated based on the time when the expected scale is highest but not less than 50 billion VND. Investment capital plans must match the projected scale of each phase.

For private secondary schools that do not build new physical facilities but only lease or use existing facilities to carry out educational operations, the minimum investment must reach 70% of the investment level stipulated in point 4a of Article 27 of Decree 125/2024/ND-CP;

+ For public secondary schools, financial resources are ensured by the competent management agency to meet the requirements of the general education program as prescribed.

- Having organizational and operational regulations for the school.

2. Conditions for establishing public lower secondary schools, upper secondary schools, and general schools with multiple levels in Vietnam

Conditions for establishing public lower secondary schools, upper secondary schools, and general schools with multiple levels or permitting the establishment of private lower secondary schools, upper secondary schools, and general schools with multiple levels (hereinafter collectively referred to as secondary schools) are specifically regulated in Article 25 of Decree 125/2024/ND-CP as follows:

- Having a proposal for the establishment or permission to establish a secondary school that is in line with provincial planning and related local planning where the school's headquarters are located.

- The scheme clearly defines the objectives, tasks, program, and educational content; land, physical facilities, equipment, proposed school construction location; organizational structure; resources and finances; strategic directions for building and developing the school.
