The following article discusses the conditions for allowing operation of preschool educational institutions in Vietnam from November 20, 2024 from November 20, 2024, as stipulated in Decree 125/2024/ND-CP.

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating conditions for investment and operation in education.
According to Article 5 of Decree 125/2024/ND-CP, the conditions for allowing operation of preschool educational institutions in Vietnam include:
- Having land, facilities, equipment, materials, and toys that meet the standards regarding location, scale, area, and minimum facilities for preschools as regulated by the Ministry of Education and Training of Vietnam.
In the inner city areas of special urban types, the area of land for school construction can be substituted with construction floor space, ensuring that the construction floor area is not less than the minimum average land area per child as regulated.
- Having educational programs, materials, and resources that meet the requirements of the preschool education program as stipulated by the Ministry of Education and Training of Vietnam.
- Having a team of management staff, teachers, employees, and workers that meets the quantity and standards to organize nurturing, caring, and educating children to meet the requirements of the preschool education program as outlined by the Ministry of Education and Training of Vietnam.
- Sufficient financial resources to ensure the maintenance and development of educational activities:
+ For private preschools, the minimum investment is 30 million VND per child (excluding land use costs). The total investment capital is calculated based on the expected highest scale. The investment capital plan must be appropriate to the expected scale for each phase.
For private preschools that do not construct new facilities but only lease or use existing facilities to implement nurturing, caring, and educating activities, the minimum investment must reach 70% of the investment level stipulated in point a, clause 4, Article 5 of Decree 125/2024/ND-CP;
+ For public and community schools, financial resources are secured by the competent authority or local community to satisfy the requirements of the preschool education program as regulated.
- Having regulations on the organization and operation of the school.
The conditions for establishing independent child groups, independent kindergarten classes, and independent public kindergartens or allowing the establishment of independent child groups, independent kindergartens, and independent private preschool classes (hereinafter collectively referred to as independent preschool education institutions) are specifically stipulated in Article 10 of Decree 125/2024/ND-CP as follows:
- Having a location, minimum facilities, materials, toys, and teaching equipment that meet the requirements of the preschool education program as regulated by the Ministry of Education and Training of Vietnam.
- Having educational plans, materials, and resources that meet the requirements of the preschool education program as regulated by the Ministry of Education and Training of Vietnam.
- Having a team of management staff, teachers, employees, and workers that meets the quantity and standards as regulated by the Ministry of Education and Training of Vietnam to organize nurturing, caring, and educating children to meet the requirements of the preschool education program.
- The scale of groups and classes in independent preschool education institutions as regulated by the Ministry of Education and Training of Vietnam.
More details can be found in Decree 125/2024/ND-CP which comes into force in Vietnam from November 20, 2024.
