This is a notable content of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 issued by the Standing Committee of National Assembly of Vietnam on December 09, 2020.
According to Article 23 of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam, officers, professional soldiers, non-commissioned officers and soldiers in the People's Army and injured officers, non-commissioned officers and soldiers in the People's Police with an injury rate of 21% or higher shall be considered and recognized as war invalids by a competent agency or unit, and issued with a "Certificate of War Invalids" and a "Badge of War Invalids" in one of the following cases:
- Fighting or directly serving in combat to protect independence, sovereignty, territorial integrity and national security;
- Performing national defense and security tasks in areas occupied by the enemy, areas with hostilities, and areas adjacent to areas occupied by the enemy;
- Directly engage in political and organized psychological warfare against the enemy; (new provision)
- Captured and tortured by the enemy but still refused to submit, resolutely fought, but left physical injuries;
- Doing international obligations;
- Courageously perform urgent and dangerous jobs in service of national defense and security;
- Directly performing combat training and maneuvering tasks or performing dangerous tasks in service of national defense and security;
- Due to an accident while directly performing national defense and security tasks in border areas, at sea or on islands with extremely difficult conditions according to the list prescribed by the Government;
- Directly performing the task of fighting crime; (new provision)
- Especially bravely saving people, saving the property of the State and the people or preventing and arresting people with criminal acts, is a meaningful example of honoring, educating and spreading widely in society; (new provision)
- Persons who are not officers, professional soldiers, non-commissioned officers and soldiers in the People's Army and injured officers, non-commissioned officers and soldiers in the People's Police with an injury rate of at least 21% or more falling into one of the cases mentioned above, they shall be considered and recognized as beneficiaries of policies as war invalids by a competent agency or unit and granted a "Certificate of beneficiaries of policies as war invalids".
- Class B invalids are military personnel or people's police officers who have been injured with an injury rate of 21% or higher while practicing or working, which has been recognized by a competent agency or unit before December 31, 1993.
Thus, it can be seen that, the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam has supplemented a number of conditions and criteria for war invalids and beneficiaries of policies as war invalids compared to the previous provisions of the Ordinance on preferential treatment given to people with meritorious services to the revolution amended in 2012. In particular, war invalids and beneficiaries of policies as war invalids under the aforesaid provisions who have recurrent, residual or additional injuries shall be examined and re-assessed the body injury rate according to the Government's regulations.
