Conclusion on judicial expertise in scientific and technological activities in Vietnam

Recently, the Ministry of Science and Technology of Vietnam issued Circular 35/2014/TT-BKHCN regulating judicial expertise in scientific and technological activities.

Circular 35/2014/TT-BKHCN stipulates the implementation of judicial expertise conclusions in Vietnam as follows:

  1. Judicial experts, ad hoc judicial experts, and ad hoc judicial expertise organizations must prepare judicial expertise conclusions following Form No. 03a, 03b, 03c in the Appendix issued with Circular 35/2014/TT-BKHCN.

  2. The signature of the individual performing the examination in cases where an individual is tasked with the examination is certified according to Clause 2, Article 32 of the Law on judicial expertise.

Regarding judicial expertise dossiers:

  1. Judicial expertise dossiers must be prepared in a uniform format and include all the contents specified in Clause 1, Article 33 of the Law on judicial expertise.

  2. Individuals and organizations conducting judicial expertises are responsible for the accuracy of the prepared dossier and must present the judicial expertise dossier upon request from the procedural conducting agency or the competent procedural authority in charge of resolving cases in accordance with procedural law.
