Compulsory remedial measures for education-related administrative violations in Vietnam

Draft Decree stipulates sanctions for education-related administrative violations in Vietnam, which has supplemented some remedial measures for organizations committing education-related violations.

Remedial measures for organizations committing education-related administrative violations in Vietnam

Article 4 Draft Decree on penalties for education-related administrative violations in Vietnam stipulates remedial measures including:

- Forced dissolution of educational institutions, organizations providing educational services;

- Forced annulment of documents issued without proper authority or containing illegal contents;

- Forced destruction of books, textbooks, lectures, materials, teaching equipment;

- Forced re-evaluation of students' results;

- Forced protection of candidates' rights in cases of lost exam papers;

- Forced transfer of eligible enrolled students to another educational institution or annulment of the admission decision, refund of collected fees if transfer is not possible;

- Forced return of students' records and documents;

- Forced return of collected money and bearing all costs for the return; if return is not possible, deposit the money into the state budget from the violation;

- Forced reduction of the number of enrollments in the following year by at least the excess number of enrollments;- Forced destruction of diploma and certificate templates;- Forced annulment of diplomas and certificates;

- Forced annulment of diploma and certificate copies;

- Forced annulment of accreditation or quality assessment results;

- Forced submission and recommendation for authorities to revoke issued documents;

- Forced transfer of students to licensed or registered educational activity locations;

- Forced supplementation of lacking course content or training programs, organizing thesis or dissertation defenses as per regulations;

- Forced assurance of safety conditions for school facilities and classrooms;

- Forced annulment of disciplinary decisions and restoration of students' right to study;

- Forced disclosure of financial receipts and expenditures;

- Forced retrieval of incorrectly spent funds for submission to the state budget;

- Forced reimbursement to students for all training costs during overseas study periods;

- Forced full disclosure of contents as per regulations.

Thus, in addition to some measures stipulated in the Law on Handling Administrative Violations, organizations committing education-related administrative violations in Vietnam may also be subject to one or more of the above remedial measures.
