The completion, issuance of documents guiding the implementation of the Law on Bidding 2023 is a matter addressed in Directive 24/CT-TTg.

On July 29, 2024, the Prime Minister of the Government of Vietnam issued Directive 24/CT-TTg to promote and enhance the effectiveness and efficiency in implementing the Bidding Law 2023.

To complete and issue detailed regulations and guidelines for the implementation of the Bidding Law 2023, the Prime Minister of the Government of Vietnam has directed the Ministries and relevant agencies to carry out the following tasks:

(1) Ministry of Planning and Investment of Vietnam:

- Urgently complete the Decree detailing certain articles and measures to implement the Bidding Law 2023 concerning the selection of investors to implement investment projects using land as stipulated at point a, clause 3, Article 2 of the Bidding Law 2023, to submit to the Government of Vietnam for issuance in July 2024;

- Issue standard bidding documents for the selection of investors to implement investment projects using land; complete in Quarter III/2024;

- Issue standard bidding documents for online procurement; online quotation; selection of contractors by the quantity of technical services to supply chemicals, testing supplies, medical equipment; and standard bidding documents for EPC packages for domestic (online) and international procurement (offline); complete in Quarter IV/2024.

(2) Ministry of Finance of Vietnam:

- Issue a Circular prescribing the list of goods and services subject to centralized procurement at the national level as assigned in Decision 857/QD-TTg dated July 18, 2023, of the Prime Minister of Vietnam; complete in Quarter IV/2024;

- Review, amend, and supplement documents on the management and use of public assets and the use of state capital to ensure compliance with the Bidding Law 2023 and Decree 24/2024/ND-CP; complete in July 2024;

- Review and propose amendments, supplements, or replacement of Decree 32/2019/ND-CP dated April 10, 2019, of the Government of Vietnam detailing the assignment, ordering, or bidding to provide public products and services using state budget funds to ensure compliance with the Bidding Law 2023; submit to the Government of Vietnam in 2025.

(3) Ministry of Health of Vietnam:

- Review documents detailing and guiding the implementation of the Bidding Law 2023 and Decree 24/2024/ND-CP issued under its authority to ensure consistency in these documents; complete in Quarter IV/2024;

- Provide guidance on the categorization of medical equipment according to technical and quality standards to fulfill the assigned tasks at point d, clause 2, Article 135 of Decree 24/2024/ND-CP; complete in Quarter III/2025.

(4) Ministers, heads of ministerial-level agencies, agencies under the Government of Vietnam, and other central agencies, Chairpersons of Provincial People's Committees:

- Review regulations on the selection of investors to implement projects within their management scope (if any) to promptly issue or submit to competent authorities documents for amendments and supplements to ensure compliance with the Bidding Law 2023, Decree 23/2024/ND-CP, and the Decree detailing certain articles and measures to implement the Bidding Law 2023 concerning the selection of investors to implement land-use projects (upon issuance); complete by December 2024;

- Issue or submit to competent authorities documents prescribing standards and criteria for evaluating investment business plans of investors suitable to the specific development conditions of sectors and fields within their management scope if necessary; complete by December 2024;

- Review and issue a list of centralized procurement goods and drugs at the local level as stipulated at point c, clause 2, Article 53 of the Bidding Law 2023; issue regulations on the selection of contractors in special cases under the authority stipulated in clause 1, Article 83 of Decree 24/2024/ND-CP; complete in Quarter IV/2024;

- Ministers, heads of ministerial-level agencies, agencies under the Government of Vietnam, other central agencies; the Provincial People's Councils promptly issue documents prescribing the authority to decide on the procurement of assets, goods, and services as stipulated in Article 91 of Decree 24/2024/ND-CP; complete in Quarter III/2024.
