Complaint in Court: Which agency’s decisions and actions are being complained about?

According to Circular 01/2020/TT-TANDTC, complaints in the People's Court include:

Complaints and denunciations in the People's Court (illustrative image)

- Complaints against decisions and acts of agencies and units under the People's Court, and of persons having jurisdiction under the People's Court regarding state administrative management in organizational structure and personnel;- Complaints against decisions and acts of agencies and units under the People's Court, and of persons having jurisdiction under the People's Court regarding management and use of the budget, capital construction, procurement, and public property management;- Complaints against decisions and acts of agencies and units under the People's Court, and of persons having jurisdiction under the People's Court regarding state administrative management in the performance of judicial functions and tasks of the People's Court;- Complaints against disciplinary decisions on officials, public employees, and workers in the People's Court;- Complaints against decisions to impose administrative penalties and implement remedial measures under the jurisdiction of the Court as stipulated in Article 48 of the Law on Handling Administrative Violations;- Complaints against decisions of agencies and persons having jurisdiction in the People's Court related to the resolution of unjust and wrong compensation claims as prescribed by the Law on State Compensation Liability;- Complaints against decisions and acts of agencies and units in the People's Court, and of persons having jurisdiction in the People's Court regarding state administrative management in other operational areas of the Court as prescribed by law.

Furthermore, denunciations in the People's Court include:

- Denunciations of illegal acts by agencies and units under the People's Court at all levels in the performance of tasks and official duties;- Denunciations of illegal acts by officials, public employees, and workers in the People's Court in the performance of tasks and official duties;- Denunciations of officials, public employees, and workers in the People's Court violating professional standards, ethical qualities, the Code of Ethics and Professional Conduct of People's Court officials, and the Code of Ethics and Conduct of Judges;- Denunciations of illegal acts regarding state management in the judicial sector of the Court are denunciations of violations by any agency, unit, or individual in the People's Court concerning compliance with legal regulations, excluding illegal acts in the performance of tasks and official duties.
