Competence to sanction administrative violations in the business of prize-winning electronic games in Vietnam

Recently, the Government of Vietnam has issued Decree No. 86/2013/NĐ-CP on the business of prize-winning electronic games for foreigners.

According to Article 49 of Decree No. 86/2013/NĐ-CP of Vietnam’s Government, competence to sanction administrative violations in the business of prize-winning electronic games for foreigners is prescribed as follows:

1. Financial inspectors at all levels on duty may:

- Impose caution;

- Forcible restoration of the original state; forcible re-export or destruction of prize-winning electronic game machines and equipment and tokens;

2. Chief inspectors of provincial-level Finance Departments and equivalent post holders who are assigned to perform the specialized inspection function may:

- Impose caution;

- Impose fine of up to VND 50,000,000;

- Confiscate material evidences and means used for commission of administrative violations which are of a value not exceeding the fine level of VND 50,000,000;

- Apply the remedial measures specified in Clause 4, Article 36 of this Decree.

3. Heads of specialized inspection teams of the Ministry of Finance may:

- Impose caution;

- Impose fine of up to VND 140,000,000;

- Confiscate material evidences and means used for commission of administrative violations which are of a value not exceeding the fine level of VND 140,000,000;

- Apply the remedial measures specified in Clause 4, Article 36 of this Decree.

4. The Chief Inspector of the Ministry of Finance may:

- Impose caution;

- Impose fine of up to VND 200,000,000;

- Deprive of the right to use business eligibility certificates for a definite time under this Decree;

- Confiscate material evidences and means used for commission of administrative violations;

- Apply the remedial measures specified in Clause 4, Article 36 of this Decree.

5. Chairpersons of People’s Committees at all levels may, within the ambit of their powers as provided in the law on handling of administrative violations, sanction administrative violations in the business of prize-winning electronic games under this Decree.
