On March 02, 2018, the Ministry of Transport issued Circular 09/2018/TT-BGTVT specifically regulating the compensation for checked baggage that does not meet quality standards due to the fault of the enterprise.
To be specific, Circular 09 stipulates that in the event of loss, reduction in weight, damage, or degradation of checked baggage, compensation will be provided according to one of the following methods:
- By an agreement between the two parties;- Based on the market price of the goods at the time of payment and place of delivery; if there is no market price for the goods, then based on the average value of goods of the same type and quality in the area where the delivery is made.
If checked baggage is partially lost, reduced in weight, damaged, or degraded in quality, compensation will be provided for the lost, reduced weight, damaged, or degraded portion; if the loss, weight reduction, damage, or degradation leads to the entire baggage being unusable, full compensation will be provided. The enterprise will have the right to ownership of the compensated damaged goods.
In addition to providing damage compensation, the enterprise must also refund the sender's entire transportation fee and collected charges.
Specifically, passengers, senders of checked baggage, and enterprises may agree on different forms and levels of compensation, or by other forms and levels agreed upon by both parties. In the absence of an agreement, compensation will be provided in accordance with legal regulations.
