Commission for the Management of State Capital performing the duties and powers of an Agency under the Government of Vietnam

On September 29, 2018, the Government of Vietnam promulgated Decree 131/2018/ND-CP specifically stipulating the implementation of tasks and powers of the agencies under the Government of Vietnam of the Committee for Management of State Capital at Enterprises.

To be specific, Decree 131 stipulates that the Committee for Management of State Capital at Enterprises shall perform the following tasks and powers:

- Propose to the Government of Vietnam the establishment, reorganization, and dissolution of organizations and units within the structure of the Committee.- Organize the implementation of training, retraining, recruitment, utilization, appointment, dismissal, rotation, transfer, retirement, commendation, discipline, and other policies for officials and public employees, direct owner representatives, state capital representatives at enterprises where the Committee acts as the owner’s representative, and employees under management authority as stipulated by law.- Prepare annual state budget estimates, medium-term financial - state budget plans for 5 years, and 3 years for the Committee to submit to competent state agencies as required by law. Coordinate with relevant agencies to develop financial mechanisms, policies, standards, and spending norms of the Committee in assigned fields. Implement financial and accounting management as stipulated by law.- Inspect the compliance with policies, laws, and assigned tasks by officials and public employees and employees under management authority; resolve complaints and denunciations within jurisdiction; prevent and combat corruption and waste as required by law.- Develop and implement solutions to enhance modern corporate governance at enterprises where the Committee acts as the owner’s representative.- Decide on investment projects within the investment authority of the Committee as required by law.- Conduct international cooperation activities as stipulated by law.- Perform other tasks and powers as assigned by the Government of Vietnam, the Prime Minister of the Government of Vietnam, and legal regulations regarding agencies under the Government of Vietnam.
