Collaborative Health Inspectors Not Included in State Payroll

Decree 122/2014/ND-CP stipulates the health inspector, official specialized inspector, and health inspection collaborators as follows:

1. Inspection Collaborators

- Inspection collaborators are individuals not part of the state inspection agency's staff in the health sector who are requisitioned to participate in the Inspection Team.- Inspection collaborators must possess good moral qualities; have a sense of responsibility, integrity, honesty, fairness, and objectivity; and have professional knowledge and expertise suitable to the inspection requirements and tasks of the requisitioning agency.- Inspection collaborators have duties, rights, and responsibilities as stipulated in Article 24 of Decree No. 97/2011/ND-CP and other relevant legal documents.- Inspection collaborators are entitled to policies as stipulated in Article 25 of Decree No. 97/2011/ND-CP and other relevant legal documents.

2. Inspectors

- Inspectors are state officials appointed to the Inspectorate to perform administrative and specialized inspections in the health sector at the Ministry of Health or Department of Health and carry out other tasks as assigned by the Chief Inspector of the Ministry of Health or the Chief Inspector of the Department of Health.- The duties, powers, and standards of inspectors are stipulated in the Law on Inspection, Decree No. 97/2011/ND-CP dated October 21, 2011, of the Government of Vietnam on inspectors and inspection collaborators (hereinafter referred to as Decree No. 97/2011/ND-CP), and other conditions, standards suitable for the sector, field as prescribed by the Minister of Health.

3. Specialized Inspection Officials

- Specialized inspection officials are staff members of the General Department, Departments under the Ministry of Health, and Sub-departments under the Department of Health assigned to perform the specialized inspection function by the head of the directly managing agency within the management scope of the General Department, Departments, and Sub-departments.- The duties, powers, and standards of specialized inspection officials are stipulated in the Law on Inspection, Decree No. 07/2012/ND-CP, and other conditions, standards suitable for the sector, field as prescribed by the Minister of Health.- When conducting inspections, specialized inspection officials are authorized to impose administrative penalties as per the law. If it exceeds their authority, they shall report to the competent authority for consideration and handling according to legal regulations.
