Classification of Fishing Ports According to the Law on Fisheries 2017

The Fisheries Law 2017 stipulates that there are 3 types of fishing ports: Type I Fishing Port, Type II Fishing Port, and Type III Fishing Port. To be recognized as one of these three types of ports, the fishing port must meet the following criteria:

  1. Type I Fishing Port

- The location attracts fishing vessels from many provinces, cities directly under the central government, and foreign vessels for loading and unloading seafood and performing other fishing services; it is a distribution hub for seafood in the region;- The main equipment serving the port's cargo handling is mechanized at a minimum rate of 90%;- The minimum area of port water is 20 hectares or more;- The depth of the channel into the port and the water area in front of the wharf is in accordance with regulations of the Government of Vietnam;- The port land area is at least 4 hectares or more; for fishing ports on islands, the port land area must be at least 1 hectare; there are offices and technical infrastructure works that comply with legal regulations on food safety, environmental protection, and fire and explosion prevention;- The quantity of seafood passing through the port is 25,000 tons/year or more; for fishing ports on islands, the quantity of seafood passing through the port is 3,000 tons/year or more.

  1. Type II Fishing Port

- The location attracts fishing vessels from several provinces, cities directly under the central government for loading and unloading seafood and performing other fishing services; it is a distribution hub for local seafood;- The main equipment serving the port's cargo handling is mechanized at a minimum rate of 70%;- The minimum area of port water is 10 hectares or more;- The depth of the channel into the port and the water area in front of the wharf is in accordance with regulations of the Government of Vietnam;- The port land area is at least 2.5 hectares or more; for fishing ports on islands, the port land area must be at least 0.5 hectares; there are offices and technical infrastructure works that comply with legal regulations on food safety, environmental protection, and fire and explosion prevention;- The quantity of seafood passing through the port is 15,000 tons/year or more; for fishing ports on islands, the quantity of seafood passing through the port is 1,000 tons/year or more.

  1. Type III Fishing Port

- The location attracts fishing vessels from local provinces and cities directly under the central government;- The port land area is at least 0.5 hectares or more; for fishing ports on islands, the port land area must be at least 0.3 hectares or more;- There are offices and technical infrastructure works that comply with legal regulations on food safety, environmental protection, and fire and explosion prevention.

  1. The authority to announce the opening and closing of fishing ports is stipulated as follows:

- The Ministry of Agriculture and Rural Development announces the opening and closing of Type I fishing ports;- The provincial People's Committee announces the opening and closing of Type II fishing ports;- The district People's Committee announces the opening and closing of Type III fishing ports.
