Circumstances in which Mobile Network Porting is Denied

Circular 35 stipulates that enterprises which are transferring out are only allowed to refuse to perform number portability for subscribers who register for porting services in one of the following cases:

- The subscriber's information registered for porting services at the receiving enterprise is inconsistent with the subscriber's information at the transferring enterprise, including the following basic information:

- For the information of individual subscribers: Information on personal identification documents including: full name, date of birth, nationality, number/date of issue/issuing authority or place of issue of the identification document, place of permanent residence registration (for individuals with Vietnamese nationality); Payment method of charges.- For the information of organization subscribers: Information on the organization's legal entity certificate, including: organization name, transaction address, number/date of issue/issuing authority or place of issue of the decision establishing the organization or business registration certificate, taxpayer registration or investment certificate, or enterprise registration certificate; List of phone numbers belonging to the organization registering for porting services; Payment method of charges.

- Violation of prohibited acts in telecommunications activities or as required by competent state authorities;

- There is a complaint or dispute regarding the use of services with the transferring enterprise;

- Violation of the contract for providing and using telecommunication services or general transaction conditions with the transferring enterprise.
