Circular No. 04/2020/TT-TANDTC: Determining the number of mediators at Courts in Vietnam

Recently, the Chief Justice of the Supreme People's Court of Vietnam has issued the Circular No. 04/2020/TT-TANDTC guiding the process of appointment, re-appointment, dismissal, commendation and handling of violations; issuance and withdrawal of mediator’s card.

According to Article 3 of the Circular No. 04/2020/TT-TANDTC of the Chief Justice of the Supreme People's Court of Vietnam, the number of mediators at Court shall be determined as follows:

1. The number of mediators is determined on the basis of the number of civil and administrative cases accepted by each Court and the following criteria:

- The court having the number of handling less than 300 cases per year shall have a maximum of 05 mediators.

- The court having the number of handling from 300 to less than 1,000 cases per year shall have a maximum of 15 mediators.

- For courts with the number of cases accepted  from 1,000 cases per year, for every 100 cases per year, 01 mediator shall be added.

2. Procedures for proposing the number of mediators

- After reviewing the year's work, based on the number of cases and the accepted cases, the Chief Justice of the People's Court of the district, urban district, town or provincial city (hereinafter referred to as the Chief Justice of the district-level People's Court) has a written request to the Chief Justice of the People's Court of central-affiliated provinces or cities (hereinafter referred to as the Chief Justice of the provincial People's Court) to assign the number of mediators.

- The Chief Justice of the People's Court of the province shall sum up the demand and propose the number of mediators of the provincial People's Court and the district People's Courts under the management of the Supreme People's Court (via the Department of Organization and Personnel).

- After the Supreme People's Court approves, the Chief Justice of the provincial People's Court shall issue a decision to assign the number of mediators to each Court under their decentralized management.
