Circular 84: Guidelines on Expenditures for Supporting Victims of Human Trafficking

This is one of the notable provisions in Circular 84/2019/TT-BTC stipulating the content, expenditure level for victim support activities, content, and expenditure level policies for victim support as stipulated in Decree 09/2013/ND-CP dated January 11, 2013, of the Government of Vietnam detailing the implementation of certain provisions of the Law on Preventing and Combating Human Trafficking.

The content and expense levels for victim support work shall comply with the current financial expenditure policies applicable to state agencies and public service providers. Circular 84/2019/TT-BTC provides specific guidance on certain content and expense levels as follows:

  1. Travel expenses for officers involved in the verification, reception, rescue, protection, and transportation of victims; organizing conferences, seminars, professional training; inspecting victim support work. The content and expense levels shall comply with the provisions of Circular 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance stipulating travel expense policies and conference expense policies.

  2. International cooperation expenses for receiving and verifying victims. The content and expense levels shall comply with the provisions of Circular 102/2012/TT-BTC dated June 21, 2012 of the Ministry of Finance stipulating travel expense policies for state officials on short-term business trips abroad funded by the state budget; Circular 71/2018/TT-BTC dated August 10, 2018 of the Ministry of Finance stipulating spending policies for receiving foreign guests working in Vietnam, organizing international conferences and seminars in Vietnam, and hosting domestic guests; Circular 219/2009/TT-BTC dated November 19, 2009 of the Ministry of Finance stipulating certain spending norms applicable to projects/programs using official development assistance (ODA) funds; and Circular 192/2011/TT-BTC dated December 26, 2011 of the Ministry of Finance amending and supplementing some provisions of Circular 219/2009/TT-BTC dated November 19, 2009 of the Ministry of Finance.

  3. Expenses for nighttime and overtime work policies: Comply with the provisions of the Labor Code and Joint Circular 08/2005/TTLT-BTC-BNV dated January 5, 2005 of the Ministry of Finance and the Ministry of Home Affairs guiding the implementation of policies for nighttime and overtime work payments for officials and public employees.

  4. Expenses for building the database and updating information about victims: The content and expense levels shall comply with the provisions of Joint Circular 19/2012/TTLT-BTC-BKHDT-BTTTT dated February 15, 2012 of the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Information and Communications guiding the management and use of funds for implementing the national program on IT application in state agencies’ operations, and Circular 194/2012/TT-BTC dated November 15, 2012 of the Ministry of Finance guiding expenditure levels for creating electronic information to maintain regular operations of agencies and units using the state budget.

  5. Expenses for renting and purchasing specialized equipment for verification, reception, rescue, and protection of victims: Follow the current laws on procurement.

  6. Expenses for communication, printing of documents, office supplies, and other related expenses for victim support work. Expense levels are based on legal invoices and expenditure documents and within the approved budget estimate.

  7. Expenses for preparing victim records: An expense of 100,000 VND per record (including photographs, verification reports, and victim transfer minutes).

  8. Financial support for non-salaried individuals directly participating in managing and protecting victims: A maximum expense of 200,000 VND per person per day.

  9. Financial support for officials assigned to provide psychological counseling to victims:

    - For counseling officials receiving salaries from the state budget: 10,000 VND per counseled person per counseling session but not exceeding 500,000 VND per official per month.

    - For counseling officials not receiving salaries from the state budget: 15,000 VND per counseled person per counseling session but not exceeding 600,000 VND per official per month.
