Circular 81: New Regulations on Locations for Citizen Reception at Detention Facilities

Recently, the Minister of Public Security issued Circular 81/2019/TT-BCA stipulating the implementation of democracy in the temporary detention and custody by the People's Public Security forces.

At Article 6 of Circular 81/2019/TT-BCA, it stipulates the locations for citizen reception at detention centers and temporary detention houses managed by the People's Public Security Forces as follows:

- The location for citizen reception and visitation is arranged in a convenient and easily identifiable place, equipped with the necessary facilities for agencies, organizations, individuals to contact, resolve work, or visit detainees and inmates.

- At the citizen reception location, there must be a sign indicating the name of the agency, unit, citizen reception officer, the rules of the reception area, and the hotline number.

- The visitation location must have a signboard "Visitation Room," partitioning wall, publicly posted rules of the detention facility, visitation regulations, suggestion box, and legal assistance information board.

- Information must be posted in easily observable locations for agencies, organizations, individuals, detainees, and inmates to be aware of and implement.

This Circular stipulates that related agencies, organizations, and individuals must strictly comply with legal regulations in the management of detainees and inmates in detention facilities. Present the required documents according to law when visiting, contacting detainees and inmates, and resolve related matters; strictly follow the rules and guidance of the officers and soldiers performing duties at the detention facility. Specifically, report and denounce any legal violations in the management and education of detainees and inmates; participate in fighting against and preventing violations of the rules of the detention facility.
