Circular 74: Authority to permit the extraction and use of archived documents in Vietnam (Illustrative Image)

According to the provisions of Article 19 Circular 74/2014/TT-BGTVT, amended by Clause 14 Article 1 Circular 61/2018/TT-BGTVT, the forms of organizing the use of archived documents in Vietnam include:

1. Using archived documents at the agency's archive.
2. Publishing archival publications.
3. Introducing archived documents on mass media and electronic information pages.
4. Exhibiting and displaying archived documents.
5. Citing archived documents in research projects.
6. Issuing copies of archived documents.

The authority to permit the extraction and use of archived documents in Vietnam is prescribed in Article 20 Circular 74/2014/TT-BGTVT amended by Clause 15 Article 1 Circular 61/2018/TT-BGTVT as follows:

1. Vietnamese officials and public employees are strictly prohibited from using the agency's archived documents for purposes contrary to the interests of the state, the legitimate rights and interests of organizations and individuals.
2. The Office Leaders permit the extraction and use of documents and sign off on verified copies, duplicates, and excerpts of documents from the agency's archive.
3. The heads of agencies or units decide on the extraction and use of their agency's or unit's documents.
4. For confidential documents, the extraction, use, preservation, submission, declassification, and destruction shall follow the law on protecting state secrets.
