Circular 51: Guidelines for inspection of compliance with mine design regulations

According to Article 9 of Circular 51/2015/TT-BTNMT which guides the inspection of compliance with mining design regulations as follows:

1. Determining the organizations or individuals extracting minerals who have submitted mining designs to the competent state management agency on minerals (excluding mineral water, hot water extraction, and mineral recovery extraction) based on the following:

- The time indicated on the postal package or the time indicated on the delivery receipt of the courier service or related documents;

- The arrival date recorded in the incoming document register at the office of the Provincial People's Committee/Department of Natural Resources and Environment where the extraction activities take place; the Ministry of Natural Resources and Environment/General Department of Geology and Minerals of Vietnam (for minerals under the licensing authority of the Ministry of Natural Resources and Environment).

2. Determining the organizations or individuals extracting minerals following the applied extraction technology or method based on the following:

- The actual extraction method (open-cast/underground/other methods) compared with the extraction method specified in the Mining License; the investment project for extraction or the approved mining design;

- The location and length of the trench openings and preparation trenches (for open-cast mining); the location, cross-section, and length of the systems of shafts/main gallery/ventilation level gallery/transportation level gallery and extraction gallery (for underground mining) at the inspection time compared with the approved investment project for extraction, mining design;

- The extraction technology; the extraction system specified in the approved investment project for extraction, mining design compared with the actual extraction, including: extraction sequence, direction of mining works; actual values of each parameter of the extraction system;

- In addition to the content at Point c of this Clause, it is also necessary to compare the values of each parameter of the extraction system with the requirements of national technical regulations and safety technical standards in mining.
