On April 25, 2017, the Minister of Finance promulgated Circular 35/2017/TT-BTC stipulating the rates, collection policies, submission, management, and use of fees for the appraisal of environmental reconstruction and restoration plans; supplementary environmental reconstruction and restoration plans appraised by central agencies.
According to the Circular, projects with a plan for renovation, restoration, and an environmental impact assessment report not approved by the same agency (case I) shall bear fees approximately 1.5 times higher compared to those approved by the same agency (case II). For example:
- Projects with a total investment capital of up to 10 billion VND shall have an appraisal fee of 6 million VND (case I), and 4 million VND (case II).
- Projects with a total investment capital of over 7,000 billion VND shall have an appraisal fee of 61 million VND (case I), and 40.7 million VND (case II).
Refer to other cases in the Fee Schedule promulgated with Circular 35/2017/TT-BTC (effective from June 10, 2017).
Fee-collecting organizations must remit 100% of the collected fees to the state budget, except in cases where the fee-collecting agency applies the budget allocation under the provisions of Clause 1, Article 4 of Decree 120/2016/ND-CP, in which they are allowed to retain 90% of the collected fees.
The Circular is effective from June 10, 2017.
