Circular 34/2019/TT-BYT: Decentralization of Authority to Establish the Military-Civilian Medical Board

This content is detailed in Circular 34/2019/TT-BYT on the organization of medical examination and treatment facilities for military-civilian and the organization of activities for the integration of military-civilian healthcare.

The authority to establish Military-Civilian Medical Boards at various levels is stipulated in Article 5 of Circular 34/2019/TT-BYT as follows:

- The Minister of Health decides to establish and promulgate the Organizational and Operational Regulations of the Ministry-level Military-Civilian Medical Board after the unanimous consent of the Ministry of National Defense.

- The Regional Commander decides to establish and promulgate the Organizational and Operational Regulations of the Regional Military-Civilian Medical Board after the unanimous consent of the Provincial People's Committees within the region.

- Based on the actual situation, the Chairman of the Provincial People's Committee decides to establish and promulgate the Organizational and Operational Regulations of the Provincial Military-Civilian Medical Board on the basis of the proposal from the Director of the Department of Health and after the unanimous consent of the Provincial Military Command.

- The Chairman of the District People's Committee decides to establish and promulgate the Organizational and Operational Regulations of the District Military-Civilian Medical Board on the basis of the proposal from the Head of the District Health Department and after the unanimous consent of the District Military Command.

Furthermore, the Circular stipulates that the Military-Civilian Medical Boards at various levels are inter-sectoral coordination bodies between military units and local government of the same level, including:

a) Ministry level;

b) Regional level;

c) Provincial level;

d) District, urban district, city under province level.

The Military-Civilian Medical Boards operate according to collective policies; the members of these Boards operate concurrently, and the number and composition of the Boards at various levels are decided by the heads of the agencies at the same level.
