Circular 29: Three-step Procedure for Releasing Wild Animals into the Natural Environment

Recently, the Ministry of Agriculture and Rural Development issued Circular 29/2019/TT-BNNPTNT providing for the handling of wild animals that are exhibits, evidence; wild animals voluntarily handed over to the State by organizations or individuals.

In accordance with regulations, the wildlife that is released back into the natural environment must be healthy and alive. The three-step process for releasing wildlife back into the natural environment, following the receipt and the handling plan of assets established under the ownership of the entire population in accordance with Clause 3, Article 11 of Circular 29/2019/TT-BNNPTNT is as follows:

Step 1: The head of the competent authority or unit handling the wildlife releases the decision to release the wildlife back into the natural environment;

Step 2: Participants in the release of wildlife back into the natural environment: the lead agency or unit releasing the wildlife, the local Forest Protection Department, the forest owner (if the releasing agency or unit is not the owner of the forest where the release is planned). The lead agency or unit may invite witnesses, judicial authorities if the wildlife is evidence, local authorities, media, and relevant parties to participate;

Step 3: The lead agency or unit shall make a release record of wildlife back into the natural environment according to Form No. 04 issued together with Circular 29.

However, when wildlife is released back into the natural environment, the following conditions must be met:

- The natural habitat of the species must be identified;- Confirmation from the specialized veterinary management agency or from the state-managed animal rescue facility that the wildlife is healthy according to the health status confirmation record of wildlife under Form No. 02 issued together with this Circular;- For wildlife that may pose a danger to humans, protective measures must be in place to ensure safety after release;- If the agency or unit releasing the wildlife is not the owner of the forest where the release is planned, the consent of the forest owner according to Form No. 03 issued together with this Circular must be obtained.
