Circular 175: 04 Responsibilities of the Department of Planning and Investment/Ministry of National Defense

The Department of Planning and Investment / Ministry of National Defence must comply with the regulations regarding responsibilities towards enterprises wholly owned by the State and the State capital in enterprises established or assigned to manage by the Ministry of National Defence. The specific contents are instructed in Article 9 Circular 157/2019/TT-BQP as follows:

- Take the lead to advise and propose to assist the Ministry of National Defence to decide or report to the competent authority to decide on matters related to enterprises wholly owned by the State established, managed by the Ministry of National Defence:

- Approve investment projects, construction, purchase, sale of fixed assets with a value greater than prescribed in point a, clause 1, Article 24 of the Law on Management and Use of State Capital Invested in Production and Business in Enterprises, relevant laws, and the enterprise's charter;- Approve the plan for liquidation, transfer of fixed assets, transfer of projects as prescribed by the Law on Management and Use of State Capital Invested in Production and Business in Enterprises, relevant laws, and the enterprise's charter;- Decide on development investment projects without delegating investment decision-making authority as stipulated in Circular 101/2017/TT-BQP.

- Supervise and inspect the investment, procurement, liquidation, transfer of fixed assets, project transfer; evaluate the effectiveness of investment projects of enterprises wholly owned by the State.- Annually, irregularly as required, consolidate and report to the Minister of National Defence on the progress and results of the implementation of development investment projects of enterprises wholly owned by the State.- Coordinate with the Department of Economics / Ministry of National Defence and other agencies, units to assist the Ministry of National Defence in performing other functions of the owners' representative agency for enterprises wholly owned by the State and the State capital invested in enterprises established or assigned to manage by the Ministry of National Defence.
