Circular 129/2020: Clarifying regulations on notification of acceptance of denunciations in Vietnam

This is a notable content of the Circular No. 129/2020/TT-BCA dated December 08, 2020 regulating the process of denunciation settlement in the people's public security of Vietnam.

According to Article 13 of the Circular No. 129/2020/TT-BCA of the Ministry of Public Security of Vietnam, notice on the acceptance of the denunciation is stipulated as follows:

- Within 05 working days from the date of issuance of the decision to accept the denunciation, the denunciation settler must notify the denouncer and denounced person of the acceptance of the denunciation and the accepted denunciation contents.

- The notice of the acceptance of the denunciation to the denouncer shall be made in one of the following two forms:

+ Send the decision to accept the denunciation.

+ Send a written notice of the acceptance of the denunciation according to the prescribed form.

- The notice of the acceptance of the denunciation to the denounced person shall be made in one of the following two forms:

+ Send a notice of the denounced content according to the prescribed form;

+ Announce the decision to accept the denunciation and the decision to establish a team to verify the denunciation contents at the agency or unit managing the denounced individual or the denounced agency or unit; the announcement shall be made in accordance with the provisions of Article 14 of this Circular.

Actually, this provision has been mentioned in Clause 4, Article 9 of the Circular No. 12/2015/TT-BCA before, but it is very vague: The denunciation settler must notify in writing the denouncer of the acceptance of the complaint. The report and the denunciation contents shall be handled according to the prescribed form. Circular 12 does not mention the time limit for issuing the notice, nor does it specify how many forms to notify about the acceptance of the denunciation. Therefore, the Circular No. 129/2020/TT-BCA of the Ministry of Public Security of Vietnam has specified this provision more clearly.
