Circular 12: Head of Verification Team formulates plan for verifying complaint contents in Vietnam

This is a noteworthy content in Circular 12/2015/TT-BCA on the procedures for resolving denunciations within the People's Public Security of Vietnam.

Article 11 Circular 12/2015/TT-BCA stipulates that the verification plan for the complaint content is developed by the Head of the Verification Team and submitted to the person who issued the decision to establish the Verification Team for approval. The verification plan for the complaint content includes:

  1. Based on the verification decision of the authorized person to proceed with the verification;
  2. The purpose and requirements of the verification;
  3. Verification content: Specifically define each complaint content that needs to be verified and clarified; methods and steps to verify each complaint content must be detailed and specific, determining what to do first and what to do later to achieve the best results;
  4. Agencies, organizations, units, individuals that need to be worked with to collect, verify information, documents, evidence; expected timeframe for each task;
  5. Coordinating verification forces (if any);
  6. Necessary conditions and means to serve the verification;
  7. Reporting on the progress of implementation;
  8. Other relevant content related to the resolution of the complaint.

In addition, after developing the verification plan for the complaint content, the Verification Team organizes a meeting to unify and deploy the verification plan, assigning members the following tasks:

- Preparing the plan to collect related documents and records;

- Preparing the content and plan to work with the complainant;

- Preparing the content and plan to work with agencies, organizations, units, and individuals being complained about; preparing content in writing for the Head of the Verification Team to sign requesting agencies, organizations, units, and individuals being complained about to provide explanations;

- Preparing content to work with subjects related to the complaint content;

- The Head of the Verification Team assigns tasks to the members of the Verification Team;

Note: The Verification Team meeting must be recorded in minutes to be filed or entered into the Verification Team's logbook.
