This is an important content in Circular 09/2012/TT-BNV issued on December 10, 2012 by the Ministry of Home Affairs on the procedures and matters regarding the recruitment, employment, and management of Vietnamese officials and public employees to be inspected.
Circular 09: Inspection of arbitrarily resigning or participating in strikes by Vietnamese officials (illustrative image)
Article 28 of Circular 09/2012/TT-BNV stipulates the matters to be inspected regarding ethics and communication culture in the performance of public duties by Vietnamese officials; the implementation of regulations on the prohibitions for Vietnamese officials as follows:
- Ethics of Vietnamese officials: The implementation of diligence, thrift, integrity, and impartiality in public service activities of officials through annual evaluations, other specific evaluations, through meeting minutes of agencies, units, and organizations with comments on the ethics of officials.
- Communication culture of officials at the workplace (spirit, attitude, communication language with colleagues; wearing badges or officials’ cards).
- Prohibitions for officials, including:
+ Prohibitions related to public service ethics: Avoiding responsibilities, shirking assigned tasks; causing factions, and disunity; arbitrarily resigning or participating in strikes; illegally using state and public assets; exploiting or abusing tasks, powers; using information related to public duties for personal gain; discrimination based on ethnicity, gender, social composition, beliefs, religion;
+ Prohibitions related to state secrets: Disclosing information related to state secrets in any form; engaging in works related to the industries, professions that they previously managed for domestic or foreign organizations, individuals, or joint ventures related to state secrets within at least 5 years from the decision of retirement or resignation;
+ Other prohibitions: Performing works related to production, business, and personnel work as regulated in the Law on Anti-Corruption, Law on Thrift Practice, Anti-Waste, and other works as regulated by law and competent authorities.
- Other matters as stipulated by law on ethics, communication culture in the execution of public duties by Vietnamese officials; and the implementation of regulations on prohibitions for Vietnamese officials.
