Circular 09: Destruction of State Secret Documents in the Culture, Sports and Tourism Sector in Vietnam

Recently, the Ministry of Culture, Sports, and Tourism has issued Circular 09/2014/TT-BVHTTDL stipulating the work on protecting state secrets in the fields of culture, sports, and tourism in Vietnam.

Circular 09/2014/TT-BVHTTDL regulates that when organizing the destruction of state secret documents, a Council for the Destruction of State Secret Documents in Vietnam must be established.

The Council for the Destruction of State Secret Documents includes: The head of the agency or unit possessing secret documents as the Chairman of the Council; representatives from agencies, units, or departments, individuals directly managing the secret documents, security officers, and representatives of relevant agencies and units as decided by the Chairman of the Council.

During the destruction process of secret documents, the following must be ensured:

- No disclosure or leakage of the content of secret documents;

- For secret documents and papers printed on paper, they must be burned, torn, or shredded to the extent that they cannot be reconstructed;

- For secret documents in the form of state secret carriers (tapes, disks, films), their entire shape must be altered, and functional properties destroyed so that they cannot be recovered, exploited, or used;

A detailed record must be created listing all destroyed secret documents, clearly noting the document number, number of copies, and an abstract of the document content. The record must reflect the method, procedure, and individuals involved in the destruction of the secret documents. The record must bear the signatures of all participants, and it must be submitted to the security department of the agency or unit for filing. For cryptographic codes, the destruction must comply with the regulations of the Government Cipher Committee of Vietnam.

Note: State secret declassification and destruction records must be kept for at least 20 years.
