Circular 06: Guidance on Procedures for Receiving Criminal Record Information

This is a new regulation issued in Circular 06/2013/TT-BTP of the Ministry of Justice providing guidance on the management, use, and exploitation of the judicial record database.

According to current regulations, judicial record information includes judicial record information in the form of paper documents and judicial record information in the form of electronic data (i.e., judicial record information in digital format following standards and technical regulations on information technology, hereinafter referred to as electronic judicial record information).

Article 8 Circular 06/2013/TT-BTP prescribes the procedure for receiving judicial record information as follows:

Step 1: Upon receiving judicial record information provided by relevant agencies in accordance with the Law on Judicial Records and other related documents, the National Judicial Record Center and the Department of Justice shall receive judicial record information in accordance with Clause 2, Article 3 of the Inter-ministerial Circular 04/2012/TTLT-BTP-TANDTC-VKSNDTC-BCA-BQP.

Step 2: After receiving judicial record information provided by the agencies, the National Judicial Record Center and the Department of Justice shall record the information into the Judicial Record Information Reception Book according to the form issued attached to Circular 13/2011/TT-BTP dated June 27, 2011, by the Minister of Justice on the issuance and guidance on the use of forms and judicial record books.

In cases where agencies or organizations provide electronic judicial record information, they are responsible for using a digital signature as prescribed by the law on electronic transactions to ensure the accuracy, integrity, and proper authority of the provided information. If agencies or organizations provide electronic judicial record information without using a digital signature, they must include information about the sender and ensure the accuracy, proper authority, and integrity of the information.
