On August 28, 2020, the Ministry of Justice of Vietnam issued Circular 05/2020/TT-BTP to provide guidance on Decree 08/2020/ND-CP regarding the organization and operation of bailiff.
Circular 05: Specific regulations on Bailiff training and retraining in Vietnam (Illustration)
Under Circular 05/2020/TT-BTP, specific regulations on Bailiff training and retraining in Vietnam are as follows:
- The Judicial Academy of Vietnam organizes Bailiff training and retraining in Vietnam as per regulations in Article 7 of Decree 08/2020/ND-CP dated January 08, 2020, of the Government of Vietnam on the organization and operation of bailiffs.
- The training and retraining content for Bailiffs includes legal knowledge of Bailiffs, civil judgment enforcement, procedure, and related laws; professional ethics for Bailiffs; and skills for practicing as Bailiffs.
- Based on the training and retraining content for Bailiffs, the Judicial Academy of Vietnam will take the lead and collaborate with the Department of Judicial Assistance, the General Department of Civil Judgment Enforcement, the Department of International Law, and related units to develop and submit the training and retraining program for Bailiffs to the Minister of Justice for promulgation.
Individuals completing the Bailiff training courses abroad will be recognized as equivalent in the following cases:
- Holding a degree in Bailiff training granted by a foreign training institution within the scope of regulation of agreements on equivalence of degrees or mutual recognition of degrees, or international treaties related to degrees to which Vietnam is a signatory or participant;
- Holding a degree in Bailiff training granted by a foreign training institution whose training program has been accredited by the quality assurance agency of that country or approved by the competent authority of that country and authorized to grant degrees.
