On June 18, 2020, the Chief Justice of the Supreme People's Court issued Circular 01/2020/TT-TANDTC regulating the resolution of complaints and denunciations in the People's Court.
Which complaints does the Chief Justice of the Provincial People's Court resolve? (illustrative image)
Article 6 of Circular 01/2020/TT-TANDTC stipulates that the Chief Justice of the Provincial People's Court resolves the following complaints:
- Resolving the first complaint against decisions and actions of oneself, officials, and employees under the management of the Chief Justice of the Provincial People's Court;
- Resolving the second complaint against decisions and actions of the Chief Justice of the District People's Court, officials, and employees under the management of the Chief Justice of the District People's Court, which has been resolved initially but is still under complaint, or if the first complaint has expired but has not been resolved.
Besides that, the authority of the chief justices of the district, high-level, and supreme people's courts is regulated as follows:
The Chief Justice of the District People's Court resolves the first complaint against decisions and actions of oneself, officials, and employees under the management of the Chief Justice of the District People's Court.
The Chief Justice of the High-Level People's Court resolves the first complaint against decisions and actions of oneself, officials, and employees under the management of the Chief Justice of the High-Level People's Court.
The Chief Justice of the Supreme People's Court resolves the following complaints:
- Resolving the first complaint against decisions and actions of oneself, officials, public employees, and employees under the management of the Chief Justice of the Supreme People's Court;
- Resolving the second complaint against decisions and actions of the Chief Justice of the Provincial People's Court, Chief Justice of the High-Level People's Court, officials, and employees under the management of the Chief Justice of the Provincial People's Court, Chief Justice of the High-Level People's Court, which has been resolved initially but is still under complaint, or if the first complaint has expired but has not been resolved.
