Regarding this issue, LawNet would like to answer as follows:

On September 29, 2023, the Minister of Public Security issued Circular 45/2023/TT-BCA regulating the provision of information by the People's Public Security Force in the online environment.

Specifically, Article 4 of Circular 45/2023/TT-BCA regulates the Ministry of Public Security's information provision channel in the network environment as follows:

- Electronic information portal of the Ministry of Public Security.

- Based on specific conditions, the Minister of Public Security decides to deploy the following channels to provide information in the network environment for organizations and individuals:

+ Ministry-level data portal;

+ Social networks;

+ Electronic mail (Email);

+ Application on mobile devices;

+ Telephone switchboard.

- Information provision channels of the Ministry of Public Security in the network environment must ensure the provision of information synchronously and consistently with information on the Ministry of Public Security's electronic information portal.

- The Ministry of Public Security's information provision channel in the online environment must meet the requirements specified in Clause 3, Article 5 of Decree 42/2022/ND-CP, specifically:

+ Ensuring convenience through many different access means, including mobile devices.

+ Allowing organizations and individuals to evaluate online the level of satisfaction with the information provided. State agencies ensure the confidentiality and privacy of evaluating organizations and individuals.

+ Ensuring network information security; applying standards and technologies to support people with disabilities in accessing and using information and communication products and services; Comply with technical regulations on providing information on the network environment.

+ The Ministry of Information and Communications guides standards to support people with disabilities in accessing and using information and communications products and services; provides information on the network environment.

05 general principles on providing information by the People's Public Security force in the online environment in Vietnam

General principles for providing information by the People's Public Security Force in the online environment include:

(1) Information provided on the network environment of the Ministry of Public Security, Police units and localities is public information, not on the list of state secrets, professional secrets and internal police secrets; is not information or documents that are not allowed to be posted publicly online; is consistent with the functions, tasks, and powers of the People's Public Security force.

(2) The provision of information by the Ministry of Public Security, Police units and localities in the online environment must fully and seriously comply with the provisions of law on access to information, information technology, network information safety, network security, Government regulations on the management, provision, and use of Internet services and online information.

(3) Electronic information portal of the Ministry of Public Security and electronic information portals, electronic information pages (hereinafter referred to as electronic information portals) of Police units and localities must ensure basic support functions and interaction functions with organizations and individuals in the network environment as prescribed in Article 7 and Article 8 of Decree 42/2022/ND-CP and relevant legal regulations.

(4) The Ministry of Public Security's electronic information portal and the electronic information portal of the Police units and localities can only cite information sources from the electronic information portals of Party and state agencies; do not cite information unrelated to the functions and tasks of the People's Public Security force.

(5) Electronic information portal of units under the Ministry; People's Public Security academies and schools; and hospitals under the Ministry of Public Security are part of the Ministry of Public Security's electronic information portal. The construction of electronic information portals for Police units and localities must be approved by the Minister of Public Security.

Circular 45/2023/TT-BCA takes effect on November 15, 2023, and replaces Circular 98/2020/TT-BCA on managing, providing information, and ensuring the operation of the Electronic Information Portal and Electronic Information Page in the People's Public Security.
