Considering the proposal of the Ministry of Natural Resources and Environment in Official Dispatch 9207/BTNMT-QHPTTND dated October 27, 2023 regarding the conversion of rice land use to non-agricultural purposes in Hanoi city, Deputy Prime Minister Tran Hong Ha has the following opinion:

- Based on appraisal opinions on conditions for changing rice land use purposes from the Ministry of Natural Resources and Environment, the Deputy Prime Minister approved the Hanoi People's Committee's decision to change the use purpose of 181 hectares of rice land to non-agricultural land to implement the investment project to build a new urban area in Mai Lam, Dong Hoi, Xuan Canh communes, Dong Anh district, Hanoi city.

- The Hanoi People's Committee is responsible before the law and resolves according to its authority the recovery of rice land belonging to the project implementation area before the Hanoi People's Committee prepares documents to submit to the Prime Minister for approval to change the use purpose of rice land to non-agricultural land to implement the project as confirmed by the Hanoi People's Committee in document 3603/UBND-TNMT dated October 26, 2023 to ensure compliance with the order and procedures specified in Point c, Clause 2, Article 68 of Decree 43/2014/ND-CP; Do not let complaints arise.

The Hanoi People's Committee organizes inspection and review of the current land use status to ensure uniformity of records and fieldwork, ensuring the target of rice cultivation land allocated by the Prime Minister; Take full responsibility before the law and the Prime Minister for deciding to change the use purpose of rice land to ensure compliance with the provisions of land law and other relevant laws, ensure economical and effective use of land; Responsible for inspecting and supervising the removal and use of topsoil according to the provisions of law; Responsible for the decision to approve investment policies and approve investors in accordance with the provisions of investment law and other relevant laws; Regularly inspect and resolve difficulties and problems in the process of organizing and implementing the change of rice land use purpose in accordance with the provisions of law.

The Hanoi People's Committee receives and fully implements the opinions of the Ministry of Natural Resources and Environment stated in the above Official Dispatch and can only decide to change the land use purpose when the project meets the conditions and comply with the provisions of law.

- The Ministry of Natural Resources and Environment is fully responsible for the content of the appraisal results report and the completeness and accuracy of the accompanying documents and propose to the Prime Minister to approve the change of rice land use purpose to implement the investment project to build new urban areas in Mai Lam, Dong Hoi, Xuan Canh communes, Dong Anh district to ensure compliance with regulations; Monitor and guide the implementation of the above-mentioned change of rice land use purpose in accordance with the provisions of law.
