Change in organizational structure of the Office of the Government of Vietnam: Some agencies no longer appear in the organizational structure

From March 1, 2025, the organizational structure of the Office of the Government of Vietnam will be implemented according to Decree 36/2025/ND-CP, replacing Decree 79/2022/ND-CP.

Change in organizational structure of the Office of the Government of Vietnam

According to Article 3 of Decree 36/2025/ND-CP, the organizational structure of the Government Office of Vietnam consists of the following units:

- General Affairs Department.

- Legal Affairs Department.

- General Economic Department.

- Industry Department.

- Agriculture Department.

- Science and Education - Social Affairs Department.

- Enterprise Renovation Department.

- International Relations Department.

- Internal Affairs Department.

- Public Service Organization Department.

- Inspection Monitoring Department (Department I).

- National Assembly, Local Authorities, and Mass Organizations Affairs Department.

- Secretariat - Editing Department.

- Administrative Department.

- Human Resources Department.

- Administrative Procedures Control Bureau.

- Administration - Finance Bureau.

- Government of Vietnam Electronic Portal.

The units belonging to the organizational structure of the Government Office of Vietnam are administrative organizations whose functions, tasks, powers, and organizational structure are specified by the Minister and Chairman of the Government Office of Vietnam. The Government of Vietnam Electronic Portal uses a seal with the National Emblem. Department I has 3 divisions; the Administrative Department has 4 divisions.

The Minister and Chairman of the Government Office of Vietnam submit to the Prime Minister of the Government of Vietnam for the issuance of the list of public service providers under the Government Office of Vietnam.

Some agencies no longer appear in the organizational structure in Vietnam

The units mentioned in Article 3 of Decree 79/2022/ND-CP that no longer appear in the organizational structure of the Government Office of Vietnam as per Article 3 of Decree 36/2025/ND-CP are:

- State Administrative Organization and Public Service Department.

- Financial Planning Department.

- Administration Bureau.

Duties and powers of the Government Office of Vietnam

According to Article 2 of Decree 36/2025/ND-CPP, the duties and powers of the Government Office of Vietnam are stipulated as follows:

(1) General advice and coordination to assist the Prime Minister of the Government of Vietnam.

(2) Administrative procedures control.

(3) Ensure information serves the leadership, direction, and administration tasks of the Government of Vietnam, Prime Minister of the Government of Vietnam.

(4) Providing information to the public.

(5) Guarantee material, technical, and logistical conditions for the activities of the Government of Vietnam, Prime Minister of the Government of Vietnam as regulated by the Communist Party and the State.

(6) Drafting and issuing legal documents and other documents within the authority of the Government Office of Vietnam in accordance with the law.

(7) Conducting document inspection and handling illegal documents according to authority and legal regulations.

(8) Organizing the prompt receipt and handling of documents submitted by ministries, central authorities, and People's Committees of provinces, related organizations and individuals to the Government of Vietnam, Prime Minister of the Government of Vietnam; issuing and managing documents of the Government of Vietnam, Prime Minister of the Government of Vietnam; building, managing, and operating the electronic document storage system at the Government Office of Vietnam as per legal regulations.

(9) Strictly and effectively conducting inspection, supervision, urging; citizen reception, complaint and denunciation resolution; anti-corruption, thrift practice, and anti-wastefulness according to legal regulations.

(10) Summarizing, guiding professional office work for the offices of ministries and central authorities, and People's Committees at the provincial level.

(11) Officials of the Government Office of Vietnam must have good political and ethical qualities, high professional expertise, and knowledge about the sector and field assigned to oversee; they are entitled to special attraction, utilization, and remuneration policies according to regulations;

(12) The Government Office of Vietnam is proactive in proposing priorities for the transfer, rotation, and secondment of officials from the ministries and central authorities, organizations, and localities to work at the Government Office of Vietnam and vice versa according to authority and regulations of the Prime Minister of the Government of Vietnam and the law. Ministries and central authorities, organizations, and localities are responsible for prioritizing the transfer, rotation, and secondment of officials as requested by the Government Office of Vietnam.

(13) Managing the organizational structure, staffing of official, the number of employees, job positions; deciding on the recruitment, usage, management, and implementing other policies for officials and public employees under management authority according to regulations.

(14) Deciding and organizing the implementation of administrative reform programs, plans, IT application, digital transformation, building an electronic Government of Vietnam, digital Government of Vietnam, following the objectives, comprehensive program on state administrative reform and legal regulations.

(15) Managing financial, assets, and other resources assigned; managing scientific research activities; conducting international cooperation according to legal regulations.

(16) Performing other duties and powers as assigned by the Government of Vietnam, Prime Minister of the Government of Vietnam, or as prescribed by law.
