Certificate of Origin of Goods Valid for 12 Months

Recently, the Ministry of Industry and Trade issued Circular 11/2020/TT-BCT stipulating the Rules of Origin for goods under the Free Trade Agreement between Vietnam and the European Union.

According to Article 26 of Circular 11/2020/TT-BCT, the Certificate of Origin is valid for 12 months from the date of issuance in the exporting Member State and must be submitted to the customs authority of the importing Member State within the validity period.

Some points to note:

- The Certificate of Origin submitted to the customs authority of the importing Member State after the 12-month validity period can still be accepted for EVFTA tariff preferences in cases where the importer was unable to submit the documents within the validity period due to force majeure or other legitimate reasons beyond the importer's control.

- In other cases of late submission, the customs authority of the importing Member State may accept the Certificate of Origin for goods imported within the 12-month validity period.

To enjoy EVFTA tariff preferences, the Certificate of Origin must be submitted to the customs authority of the importing Member State in accordance with its regulations. The customs authority may require a translation if the Certificate of Origin is not in English.
