Cases of Revocation and Cancellation of Railway Connection Permits

Recently, Circular 26/2018/TT-BGTVT was issued by the Ministry of Transport stipulating the conditions, order, and procedures for the implementation of the connection of urban railway tracks, dedicated railway tracks with national railways; connection of tracks of urban railway lines. Circular 26 takes effect from July 01, 2018, replacing Circular 05/2011/TT-BGTVT.

According to Circular 26, the railway connection permits will be revoked or canceled in the following cases:

- The permit was issued not in accordance with legal regulations;- The project investor organizes the implementation or directly carries out the work not according to the contents of the permit. If more than 1/3 of the construction connection time in the permit has elapsed from the date the competent state authority detects and requests in writing, but the investor has not yet completed the rectification of violations as requested;- The project investor violates legal regulations on the management, protection of railway infrastructure, railway traffic safety, fire prevention and fighting, and environmental sanitation in the connection area;- After 12 months from the date of issuance of the permit, the investor has not yet commenced the connection construction.
