Circular 02/2017/TT-BTP was issued by the Ministry of Justice on March 23, 2017, to specifically stipulate the cases of Delegation of Authority to the Head, or assignment to be in charge of the unit.
Circular 02 stipulates that in cases where there is no personnel meeting the requirements for appointment as Director of the Civil Judgment Enforcement Department, the General Department of Civil Judgment Enforcement shall organize a collective leadership meeting of the General Department to introduce and propose personnel to assign the authority of the department head or to assign responsibilities to the Civil Judgment Enforcement Department for reporting to the Communist Party Personnel Committee of the Ministry of Justice.
In cases of assigning the authority of the department head, the General Department of Civil Judgment Enforcement shall submit to the Communist Party Personnel Committee of the Ministry of Justice to sign an Official Dispatch to exchange and seek written opinions from the provincial-level party committee on the proposed personnel.
Additionally, Circular 02 also stipulates that based on the Resolution of the Communist Party Personnel Committee of the Ministry of Justice and the opinions of the local party committee (if any), the General Department of Civil Judgment Enforcement shall submit to the Minister of Justice a decision to assign the authority of the department head or to assign responsibilities to the Civil Judgment Enforcement Department.
