Case File for Settlement of Subsidy Policies for Retired Teachers Who Have Not Received Seniority Allowance

At Article 5 of Decree 14/2020/ND-CP, detailed guidance is provided on the dossier to calculate the entitlement to allowance policies for retired teachers who have not yet received seniority allowance policies in their pensions as stipulated in Article 2 of this Decree.

To be specific, for teachers who are receiving pensions, it is necessary to prepare a declaration form to request allowance, issued together with this Decree (Form No. 01).

For teachers eligible for allowance who have not been resolved policies and passed away from January 01, 2012 onwards, the dossier includes:*

- A declaration form requesting allowance by the next of kin, issued together with this Decree (Form No. 02).- A photocopy of the Death Certificate or Death Notice or a Court decision declaring the person deceased (bring the original for comparison).- A power of attorney document as prescribed in Clause 2, Article 4 of this Decree (Form No. 03); in case there is only one next of kin, this power of attorney document is not required.

Within 20 working days from the date the district-level social insurance office receives the complete dossier from the eligible person as prescribed in Article 5 of this Decree, the social insurance office is responsible for resolving and disbursing the allowance to the eligible person. If not resolved, a written response must be provided, stating the reasons clearly.

It should be noted that, when Decree 14/2020/ND-CP takes effect, Decision 52/2013/QD-TTg dated August 30, 2013, regulating allowance policies for retired teachers who have not yet received seniority allowance policies in their pensions, will simultaneously cease to be effective. Teachers covered under Decree 14 who have already been resolved policies under Decision 52/2013/QD-TTg will not be entitled to benefits, nor will they receive adjustments to the allowances they have already received as per Decree 14.
